Universal Terms of Service Agreement

Effective Date: July 16, 2025

Welcome to eBurst Services Inc. (“we,” “us,” or “our”). By accessing or using our website, products, or services (collectively, the “Services”), you agree to comply with and be bound by this Terms of Service Agreement (“Agreement”). If you do not agree to these terms, please do not use our Services.

1. Acceptance of Terms

By using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including all policies incorporated herein. We reserve the right to modify or update these terms at any time without prior notice, and your continued use of the Services signifies acceptance of any changes.

2. Eligibility

You must be at least 18 years old or of legal age in your jurisdiction to use our Services. By using our Services, you represent and warrant that you meet these age requirements.

3. User Responsibilities

  • You agree to provide accurate, current, and complete information when registering or using our Services.
  • You are responsible for maintaining the confidentiality of your account login information, including your Alphanumeric PIN, and for all activities that occur under your account.
  • You agree to re-authenticate into your account after 3 hours of inactivity or idle texting.
  • You agree not to misuse the Services, including but not limited to transmitting harmful, illegal, or unauthorized content.
  • You shall not attempt to interfere with or disrupt the operation of the Services or compromise their security.

4. Prohibited Activities

You agree not to:

  • Use the Services for any illegal, fraudulent, or unauthorized purposes.
  • Engage in any activity that could harm, disable, or impair the Services or servers.
  • Attempt to gain unauthorized access to any part of the Services or accounts.
  • Use automated means to access or collect data from the Services.
  • Infringe upon the intellectual property rights of others.

5. Payment and Billing

  • Invoices & Late Fees:
    • 30 days delinquent: A late fee will be added to the outstanding invoice.
    • 60 days delinquent: An additional late fee will be added, and all services may be suspended until payment is made.
    • 90 days delinquent: An additional late fee will be added, and the account will be sent to collections, including legal and collection fees.
    • After collection fees are paid, the decision to resume services will be at the sole discretion of the eBurst Services Inc. Board of Directors.
  • Accepted Payment Methods (as of December 31, 2025):
    • Credit/Debit Card
    • PayPal
    • Venmo
    • Wire Transfer (available upon request)
  • You agree to pay all applicable fees and charges. Payments are non-refundable unless explicitly stated. We reserve the right to suspend or terminate your access if payments are overdue or if you violate this Agreement.

6. Intellectual Property

All content, trademarks, logos, and other intellectual property associated with the Services are owned by or licensed to eBurst Services Inc. You agree not to reproduce, distribute, modify, or create derivative works without our prior written consent.

7. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using our Services, you consent to such data practices.

8. Address Spoofing and Data Reporting

We offer address spoofing services to redact or hide your personal address upon your request, in compliance with applicable laws. We also utilize third-party platforms to retrieve and report certain information, and you agree to our data collection and reporting practices as detailed in our Privacy Policy.

9. Support Inquiries

All support requests must be submitted via email to the appropriate support email channel or by completing a support ticket on our website. Support inquiries sent through other channels may not be addressed.

10. Limitation of Liability

To the maximum extent permitted by law, eBurst Services Inc. shall not be liable for any damages arising from the use or inability to use our Services, including but not limited to consequential, incidental, or punitive damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless eBurst Services Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses resulting from your violation of this Agreement or misuse of the Services.

12. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and without prior notice. If your account is sent to collections, the resumption of services will be at the sole discretion of the eBurst Services Inc. Board of Directors, and only after all collection-related fees are paid.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflicts of law principles.

14. Dispute Resolution

Any disputes arising under this Agreement shall be resolved through binding arbitration in Palm Beach County, Florida, in accordance with the rules of the American Arbitration Association.

15. Miscellaneous

  • Entire Agreement: This Agreement, along with our Privacy Policy, constitutes the entire understanding between you and eBurst Services Inc. regarding the use of our Services.
  • Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in effect.
  • Waiver: Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.
